Terms of Service (BETA)

🛠️ 1. Service Description

ServeBeer provides IPFS (InterPlanetary File System) content pinning services. We operate as a technical infrastructure provider for decentralized content storage.

What we do:

• Pin IPFS content to distributed Raspberry Pi nodes
• Provide file upload directly to IPFS network
• Maintain decentralized infrastructure through community sponsorship
• Enable access to content via multiple IPFS gateways

What we don't do:

• Store content on centralized servers
• Moderate or review user content
• Guarantee permanent storage (depends on network)
• Provide customer support like traditional cloud services

👤 2. User Responsibilities

You must:

• Comply with all applicable laws in your jurisdiction
• Respect intellectual property rights
• Use the service for lawful purposes only
• Maintain the security of your account credentials
• Report any security vulnerabilities responsibly

You must not:

• Pin illegal, harmful, or infringing content
• Use the service for malicious purposes
• Attempt to circumvent storage limits or restrictions
• Share your account credentials with others
• Abuse the service infrastructure or other users

🚫 3. Prohibited Content

The following content is strictly prohibited and will result in immediate account termination:

• Illegal material as defined by applicable law
• Copyright infringement - content that violates intellectual property rights
• Malware and harmful code - viruses, trojans, or malicious software
• Privacy violations - personal information without consent
• Harassment content - material promoting harm to individuals or groups
• Spam and abuse - excessive or repetitive content designed to abuse the system

Content Responsibility: Since IPFS is a content-addressed system, we cannot preview or moderate content before it's pinned. Users are responsible for ensuring their content complies with these terms.

📊 4. Service Limits

Storage Tiers:

• Free tier: Unlimited (beta)
• Paid tier: Unlimited (beta)
• Service availability: Best-effort uptime (typically 99%+)
• Rate limits: Removed (beta)

Fair Use Policy:

• Test responsibly - don't abuse the beta service
• Commercial use requires appropriate tier subscription
• Excessive usage may result in throttling or account review

⚖️ 5. DMCA & Content Removal Policy

📧 File a DMCA Takedown Notice

If you believe content on our gateway infringes your copyright, send a notice to our DMCA Agent with:

• Identification of copyrighted work: Describe the work you claim is infringed
• Identification of infringing material: Provide the IPFS CID and/or URL
• Contact information: Your name, address, phone, and email
• Good faith statement: "I have a good faith belief that use of the material is not authorized"
• Accuracy statement: "I swear, under penalty of perjury, that the information is accurate"
• Your signature: Physical or electronic signature

🔄 Counter-Notification Process

If your content was removed and you believe the removal was in error, you may file a counter-notification containing:

• Your contact information
• Identification of removed content (CID)
• Statement under penalty of perjury that removal was a mistake or misidentification
• Consent to jurisdiction of federal court
• Your physical or electronic signature

⚠️ Important DMCA Notes

• False DMCA claims may result in legal liability
• Content removed from our nodes may still exist on other IPFS nodes
• Repeated infringement may result in account termination
• We forward counter-notifications to the original complainant

Other Content Removal Reasons:

• Violates these Terms of Service
• Subject to valid court order
• Threatens service stability or security
• Violates applicable laws

⚖️ 6. Limitation of Liability

ServeBeer is provided "AS IS" without warranties of any kind.

We are not liable for:

• Content availability or permanence
• User-generated content and its consequences
• Service interruptions or downtime
• Data loss or corruption
• Third-party actions or IPFS network issues
• Indirect, incidental, or consequential damages

Maximum Liability: Our total liability is limited to the amount you paid for the service in the past 12 months.

🔒 7. Privacy

We collect minimal data necessary for service operation:

• Account information: Email address or wallet address
• Usage data: Storage usage, pinned CIDs, timestamps
• Technical logs: IP addresses, error logs, security events

We do NOT:

• Track your browsing behavior
• Sell your data to third parties
• Store or analyze your file content
• Require KYC or identity verification

🚪 8. Account Termination

We may terminate accounts that:

• Violate these Terms of Service
• Engage in abusive or illegal behavior
• Fail to pay subscription fees (for paid accounts)
• Remain inactive for extended periods

User-initiated termination:

• Users may delete their accounts at any time
• Content will be unpinned from our nodes
• Account data will be deleted within 30 days
• Beta accounts can be deleted immediately

📝 9. Changes to Terms

We may update these terms as our service evolves:

• Users will be notified of significant changes via email
• Continued use constitutes acceptance of updated terms
• Users who disagree may terminate their accounts
• Changes become effective 30 days after notification
